Terms & Conditions

These Terms & Conditions govern your use of Calmharbor's website and your participation in our educational sessions and workshops. Please read them carefully before booking or attending any session.

By using our website, submitting an enquiry, booking a session, or attending a session, you confirm that you have read and agree to these Terms & Conditions. If you do not agree, please do not use our website or services.

You must be at least 18 years of age to book or attend a session. By booking, you confirm that you meet this requirement and have the legal capacity to enter into these terms.

3. Service Description

Calmharbor provides educational sessions and document organisation workshops relating to retirement processes in Malaysia. Our sessions cover general information about retirement frameworks, official bodies, and document organisation. They are designed to help participants feel better informed before approaching relevant authorities.

Important: Calmharbor is not a licensed financial adviser, financial planner, or investment adviser. Nothing provided during our sessions or on our website constitutes personal financial advice, investment guidance, or any regulated financial service. All content is general educational information only. Participants are responsible for seeking appropriate licensed professional advice for personal financial decisions.

Sessions are offered in person at our Petaling Jaya premises. Availability is subject to scheduling and may vary.

4. Bookings & Payment

Booking

Bookings are made by contacting us via our website enquiry form or by telephone. A booking is confirmed when we issue a written confirmation and invoice.

Fees

All fees are in Malaysian Ringgit (RM) and are inclusive of any applicable taxes unless stated otherwise. Fees are payable in advance of the session as detailed on your invoice.

As a participant, you agree to:

We reserve the right to ask any participant to leave a session if their behaviour is disruptive or disrespectful, without refund.

6. Intellectual Property

All session materials, guides, checklists, website content, and methodologies produced by Calmharbor remain our intellectual property. We grant participants a personal, non-transferable licence to use materials provided during sessions for their own individual retirement planning purposes. You may not copy, reproduce, sell, or distribute our materials to third parties without our written permission.

7. Session-Specific Terms

Documents Brought to Workshops

For the Paperwork Organisation Workshop and Full Retirement Information Journey, participants are encouraged to bring their own retirement-related documents. These documents remain your property at all times. We do not retain copies of personal documents. Facilitators handle documents only to assist with organisation, not for any other purpose.

Follow-Up Support

Follow-up factual support is included in the Full Retirement Information Journey programme. This support covers general factual queries arising from session content and does not constitute personal financial advice. The scope and duration of follow-up support is as described at the time of booking.

Group Format

Sessions may be conducted in small groups or one-to-one format. We reserve the right to adjust group sizes to maintain session quality.

8. Disclaimers

Calmharbor's sessions and materials are provided for general educational purposes only. We make no representations that information provided is complete, current, or applicable to any individual's personal circumstances. Retirement frameworks and official processes in Malaysia are subject to change; while we review our materials regularly, we cannot warrant that all information reflects the most current position at the time of a session.

Nothing in our sessions, materials, or website constitutes legal advice, financial advice, tax advice, or any other form of professional advice. Participants should seek advice from appropriately licensed professionals for matters specific to their personal situation.

9. Limitation of Liability

To the maximum extent permitted by Malaysian law, Calmharbor's total liability to any participant for any claim arising from or related to our sessions, materials, or website shall not exceed the fee paid by that participant for the relevant session.

We are not liable for any indirect, consequential, incidental, or special loss or damage, including loss of income, financial decisions made on the basis of general information provided, or any action taken or not taken in reliance on session content.

Nothing in these terms limits our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded under Malaysian law.

10. Indemnification

You agree to indemnify and hold harmless Calmharbor, its facilitators, and its officers from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these terms, your misuse of session materials, or any false or misleading information you provide to us.

11. Termination

Either party may end a booking by providing written notice. Refund terms in Section 4 apply. We reserve the right to refuse bookings or terminate participation at any time where we have reasonable grounds to do so. Upon termination, provisions of these terms that are intended to survive (including disclaimers, liability limits, and dispute resolution) continue to apply.

12. Dispute Resolution

These Terms & Conditions are governed by the laws of Malaysia. Any dispute arising from these terms or from participation in our sessions shall first be referred to informal resolution by contacting us at [email protected]. We will endeavour to respond within 14 days. If informal resolution is not achieved within 30 days, disputes shall be referred to the courts of Malaysia, and both parties submit to the jurisdiction of those courts.

Malaysian consumer protection legislation, including the Consumer Protection Act 1999, may apply to your engagement with us.

We may update these Terms & Conditions from time to time. The current version will always be available on this page, with the "Last Updated" date revised accordingly. Material changes will be communicated to participants with existing bookings by email where practicable. Continued participation in our sessions after an update constitutes acceptance of the revised terms.
